Dr. Frank Matravers noticed a number of other employees at Pleasantville Medical Hospital heading to the hospital administrator’s office for 10 minutes at a time one day at work. Then Matravers gets a phone from the administrator’s office, asking him to come in at 2:00 p.m. When Matravers arrives, he is surprised to see Janine Chou, the Hospital’s legal counsel. Chou explains that she is assisting the hospital in the investigation of a HIPAA “privacy” rule violation. (The Health Insurance Portability and Accountability Act of 1996 is known as HIPPAA.) Matravers then realizes that he has heard about this from Dr. Isabella Gardner, one of the hospital’s psychiatrists. He first learned about it two weeks prior, while dining with Gardner and her husband, as well as another of the hospital’s doctors, at a local restaurant.
Gardner had informed them about a patient who had recently relocated to Pleasantville after serving 20 years in jail for many sexual crimes on the other end of the state. He couldn’t leave the state while on probation, but he desperately wanted to get out of a town where everyone knew his story. She claimed that her patient was depressed and had sleep issues, but she questioned if he was genuinely guilty of the murders based on his case history and their chats.
The exchange was just standard “shop banter” between coworkers at the time. However, because the conversation took place at a restaurant, it’s possible that some of what Gardner said was overheard by others. Gardner’s spouse, who did not work at the hospital, was undoubtedly aware of the events! Who knows what else Gardner told her husband about her coworkers’ patients?
Matravers recognizes after seeing the news story that he did not offer Chou an accurate answer concerning other hospital personnel. He did, in fact, break HIPAA by listening to Gardner, and he knows of two other workers, Gardner and the second doctor who attended the meal, who also broke HIPAA.
